Throughout the Republic of India, the Indian Penal Code 1862 is recognised as the supreme criminal law. Indian Penal Code 1862 is a comprehensive criminal code that seeks to regulate every facet of criminal procedure. In 1862, Indian Penal Code became law throughout the British Empire, with the exception of the Princely States, which maintained their own legal systems and courts.
The purpose of the Indian Penal Code is to define criminal behavior, along with the consequences for engaging in it. The “intention” of the offender is crucial in determining the gravity of the crime.
When someone goes beyond planning an illegal act and actually makes an attempt to carry it out, they incur criminal liability.
The Indian Penal Code defines a variety of crimes after an introductory section that includes justifications and exemptions for their inclusion.
Broad classification of crimes under the Indian Penal Code (IPC) –
As was mentioned, the Indian Penal Code is the primary source for Indian criminal law. There are numerous typical crimes outlined. It defines murder, theft, and assault, among other crimes, and specifies punishments for each.
There are five distinct forms of punishment available to a court under section 53 of the Indian Penal Code. There is the possibility of death, life in prison, shorter terms of imprisonment, harsher terms of imprisonment, property forfeiture, and monetary fines.
Both the Indian Penal Code and the CrPC are parts of Indian law, though the former is more substantive than the latter. The IPC lists several offences and divides them up into various subcategories. Penalties and punishments for each offence are clearly spelled forth in the Code. On the other hand, the Criminal Procedure Code lays out the steps law enforcement must take while investigating a possible violation of any of the crimes listed in the penal codes.
IPC was enacted to serve as the country’s primary penal code, outlining the rules for punishing criminals. Contrarily, the primary goal of the CrPC is to establish mandatory practises that must be implemented during the conduct of a criminal trial. The IPC does not include provisions for courts or the Magistrate’s authority, although the CrPC, 1973 does.
