According to Section 124 A of the Indian Penal Code(IPC), “Whoever, by words, either spoken or written, or by signs, or by visible representation, or otherwise, brings or attempts to bring into hatred or contempt, or excites or attempts to excite disaffection towards the Government established by law in India shall be punished with [imprisonment for life], to which fine may be added, or with imprisonment which may extend to three years, to which fine may be added, or with fine.”
There are three clarifications in the provision as well:
1.”Disaffection” encompasses both disloyalty and general animosity;
In addition to a possible fine, anyone convicted of sedition face a mandatory three-year minimum jail sentence and possibly a life sentence. In addition, a person convicted of this offence cannot apply for a job with the government.
In Queen-Empress v. Jogendra Chunder Bose, 1891, 20 years after the statute of sedition was originally introduced in India, it was first used in a court case. For printing an article critical of the British government’s Age of Consent Act, which increased the legal age for consent to sexual intercourse, the publisher, editor, manager, and printer of the Bengali magazine Bangobasi were taken to court. However, no one was found guilty in this instance. This jurors just couldn’t agree on anything.
On numerous instances, Indian courts have addressed the meaning of Section 124A and defined the parameters within which speech becomes seditious. When defining sedition, the Supreme Court has narrowed it to “actions containing encouragement to violence or intention or tendency to create public disorder or cause disruption of public peace,” as in Kedarnath versus the State of Bihar. Finally, it has been clearly declared in the case of Balwant Singh vs. Union of India that “any statement of criticism is not sedition, and the genuine intent of the speech needs to be taken into consideration before classifying it as a seditious conduct.”
In this decision, the Supreme Court ruled that citizens have the freedom to express their opinions on the activities of the government and its officials, so long as they do not advocate for the violent overthrow of the lawfully created government or cause widespread unrest. It also ruled that a journalist cannot be charged of spreading false information or rumours if he covers topical issues of great significance in order to draw attention to pressing problems.
The panel agreed that disagreeing with a decision made by the Central Government cannot be labelled as seditious speech.
According to the Delhi High Court, the people in a democracy serve as the government’s “conscience guards.” They cannot be locked up for their political beliefs alone. Government programmes can benefit from inclusion of divergent viewpoints and a healthy dose of criticism, scepticism, and dissent.
The Supreme Court made the observation that citizens’ right to free expression cannot be curtailed by their involvement in criminal prosecutions unless their statements threaten public safety. Victims’ statements of displeasure and speaking up are a scream for sadness, for justice denied or postponed, especially when state officials turn a blind eye or stall their feet.
The Union government has informed the Supreme Court that it will be reconsidering the sedition statute and has also indicated that the Supreme Court may review the constitutionality of the sedition law once the process of reconsideration has been completed. In light of this, the Court has advised that governments refrain from filing formal complaints or adopting any coercive action in cases involving sedition while the subject is under review.
भारतीय दंड संहिता की धारा 124 A के अनुसार, “जो कोई भी, शब्दों द्वारा, या तो बोले गए या लिखित, या संकेतों द्वारा, या दृश्य प्रतिनिधित्व द्वारा, या अन्यथा, घृणा या अवमानना करता है या लाने का प्रयास करता है, या उत्तेजित करता है या भारत में कानून द्वारा स्थापित सरकार के प्रति असंतोष भड़काने का प्रयास [आजीवन कारावास] से दंडित किया जाएगा, जिसमें जुर्माना जोड़ा जा सकता है, या कारावास के साथ जो तीन साल तक बढ़ाया जा सकता है, जुर्माना जोड़ा जा सकता है, या जुर्माना लगाया जा सकता है। ”
प्रावधान में तीन स्पष्टीकरण भी हैं:
संभावित जुर्माने के अलावा, राजद्रोह के दोषी किसी भी व्यक्ति को तीन साल की न्यूनतम जेल की सजा और संभवतः आजीवन कारावास की सजा का सामना करना पड़ सकता है। इसके अलावा, इस अपराध का दोषी व्यक्ति सरकार के साथ नौकरी के लिए आवेदन नहीं कर सकता है।
रानी-महारानी बनाम जोगेंद्र चंद्र बोस, 1891 में, राजद्रोह की क़ानून को मूल रूप से भारत में पेश किए जाने के 20 साल बाद, इसे पहली बार एक अदालती मामले में इस्तेमाल किया गया था। ब्रिटिश सरकार के ऐज ऑफ कंसेंट एक्ट की आलोचना करने वाले एक लेख को छापने के लिए, जिसने सहमति से संभोग के लिए कानूनी उम्र बढ़ा दी, बंगाली पत्रिका बंगोबासी के प्रकाशक, संपादक, प्रबंधक और प्रिंटर को अदालत में ले जाया गया। हालांकि इस मामले में किसी को दोषी नहीं पाया गया। यह जूरी सदस्य किसी भी बात पर सहमत नहीं हो सके।
कई उदाहरणों पर, भारतीय अदालतों ने धारा 124ए के अर्थ को संबोधित किया है और उन मापदंडों को परिभाषित किया है जिनके भीतर भाषण देशद्रोही हो जाता है। राजद्रोह को परिभाषित करते समय, सर्वोच्च न्यायालय ने इसे केदारनाथ बनाम बिहार राज्य के मामले में “हिंसा को प्रोत्साहित करने वाली कार्रवाई या सार्वजनिक अव्यवस्था पैदा करने या सार्वजनिक शांति भंग करने की प्रवृत्ति” तक सीमित कर दिया है। अंत में, बलवंत सिंह बनाम भारत संघ के मामले में यह स्पष्ट रूप से घोषित किया गया है कि “आलोचना का कोई भी बयान राजद्रोह नहीं है, और इसे देशद्रोही आचरण के रूप में वर्गीकृत करने से पहले भाषण की वास्तविक मंशा पर विचार करने की आवश्यकता है।”
इस फैसले में, सुप्रीम कोर्ट ने फैसला सुनाया कि नागरिकों को सरकार और उसके अधिकारियों की गतिविधियों पर अपनी राय व्यक्त करने की स्वतंत्रता है, जब तक कि वे कानूनी रूप से बनाई गई सरकार को हिंसक रूप से उखाड़ फेंकने या व्यापक अशांति पैदा करने की वकालत नहीं करते हैं। इसने यह भी फैसला सुनाया कि एक पत्रकार पर झूठी सूचना या अफवाहें फैलाने का आरोप नहीं लगाया जा सकता है, यदि वह महत्वपूर्ण समस्याओं की ओर ध्यान आकर्षित करने के लिए सामयिक मुद्दों को कवर करता है।
पैनल ने माना कि केंद्र सरकार के किसी फैसले से असहमत होने को देशद्रोही भाषण नहीं कहा जा सकता।
दिल्ली उच्च न्यायालय के अनुसार, लोकतंत्र में लोग सरकार के “विवेक के रक्षक” के रूप में कार्य करते हैं। उन्हें केवल उनकी राजनीतिक मान्यताओं के लिए बंद नहीं किया जा सकता है। विभिन्न दृष्टिकोणों को शामिल करने और आलोचना, संदेह और असहमति की स्वस्थ खुराक से सरकारी कार्यक्रम लाभान्वित हो सकते हैं।
सर्वोच्च न्यायालय ने टिप्पणी की कि नागरिकों के स्वतंत्र अभिव्यक्ति के अधिकार को आपराधिक मुकदमों में उनकी भागीदारी से कम नहीं किया जा सकता है जब तक कि उनके बयानों से सार्वजनिक सुरक्षा को खतरा न हो। पीड़ितों के नाराजगी और बोलने के बयान दुख की चीख हैं, न्याय से इनकार या स्थगित होने के लिए, खासकर जब राज्य के अधिकारी आंखें मूंद लेते हैं या अपने पैरों को रोकते हैं।
केंद्र सरकार ने सुप्रीम कोर्ट को सूचित किया है कि वह राजद्रोह क़ानून पर पुनर्विचार करेगी और यह भी संकेत दिया है कि सुप्रीम कोर्ट पुनर्विचार की प्रक्रिया पूरी होने के बाद राजद्रोह कानून की संवैधानिकता की समीक्षा कर सकता है। इसके प्रकाश में, न्यायालय ने सलाह दी है कि सरकारें राजद्रोह से जुड़े मामलों में औपचारिक शिकायत दर्ज करने या किसी भी कठोर कार्रवाई को अपनाने से बचती हैं, जबकि विषय की समीक्षा की जा रही है।
