is defined as a Culpable Homicide under section 299 of the Indian Penal Code.
Difference between Murder and Culpable Homicide
“All murders are culpable homicide, but all culpable homicides are not murder.”
Although the terms murder & culpable homicide are often used interchangeably, they are not synonymous. Culpable homicide is defined in Section 299 of the Indian Penal Code, whereas murder is addressed in Section 300.
It was determined in the case State of A.P. v. R. Punnayya 1976 that “culpable homicide” is the generic term and “murder” is the specific term for the act in question. It is true that all acts of “murder” are acts of “culpable homicide,” but this is not necessarily the case vice versa. Simply put, “culpable homicide” does not amount to murder unless “specific characteristics of murder” are also present. The IPC essentially takes into account three degrees of culpable homicide for the aim of determining punishment according to the intensity of this offence. The first is “culpable homicide of the first degree,” also known as “murder,” which is the most severe kind of culpable homicide under section 300. The second one is ‘culpable homicide of the second degree’ This is a violation of Section 304, subsection 1 and carries a fine. The last one is . Part II of Section 304 establishes a graduated scale of punishment for culpable homicide, with this lowest level carrying the lightest sentence.
The intent and likelihood of death are lower in Culpable Homicide than they are in Murder.
Culpable homicide is not deemed a murderous act in the following cases, per Section 300 of the IPC:
Murder and culpable homicide are separated by a fine line. Even though the consequences of both crimes are the same, the courts have made repeated attempts to distinguish between them by looking at the intentions of the perpetrators.

हत्या की तुलना में अपराधी हत्या में मृत्यु की मंशा और संभावना कम होती है।
