‘Bail’ connotes the procedure of gaining the release of an accused charged with specific charges by ensuring his future attendance in the court for trial and ordering him to remain within the jurisdiction of the court. The Criminal Procedure Code of 1973 does not define the word “Bail.” Section 2(a) of the Criminal Procedure Code only defines “Bailable Offense” and “Non-Bailable Offense.”
Offenders have the right to be released on bond in cases when they have committed certain crimes. Whereas, the accused has no automatic right to bail if they are charged with an offence that is not bailable. Rather, the court has the final say on whether or not to award.
Bail in cases of “bailable offences” is addressed in Section 436 of the Criminal Procedure Code. It requires the police officer and the court to release the defendant on bond “as a matter of absolute and indefeasible right,” even if the defendant does not request his release. They must tell the accused of his right to be freed on bail based on his own personal recognisance and without the need for a guarantor.
If the defendant fails to appear in court at the specified time and location, as required by the bail bond, the court may revoke his release under Section 436 (2).
In the event of a non-bailable offence, bail provisions are discussed in Section 437. The accused has no automatic right to bail under this provision. The decision rests entirely within the court’s jurisdiction.
The court will consider the following points before granting bail:
After posting bail, the court will release the arrested individual from police custody. In accordance with Section 437 and Section 439 of the Criminal Procedure Code, an accused person may petition for ordinary bail.
To provide the accused some breathing room while his regular or anticipatory bail application is underway, the court has issued a direct order granting him temporary and short-term bail.
Bail is granted prior to an arrest on a direct order from Sessions or High Court. Anticipatory bail is requested when a person fears they will be arrested. An application for anticipatory bail can backfire if it tips off the authorities that the defendant is likely involved in criminal activity.
Any bail granted may be revoked by the court under the circumstances outlined in Section 437(5) of the Criminal Procedure Code. A Sessions Court, High Court, or Supreme Court can cancel bail and remand an accused person to custody at any time on its own accord under Section 439(2). An appellate court may also cancel bail and issue an arrest warrant for an accused person in accordance with Section 389(2).
‘जमानत’ विशिष्ट आरोपों के आरोप में आरोपी को रिहा करने की प्रक्रिया को दर्शाता है, जिसके तहत मुकदमे के लिए अदालत में उसकी भविष्य की उपस्थिति सुनिश्चित की जाती है और उसे अदालत के अधिकार क्षेत्र में रहने का आदेश दिया जाता है। 1973 की आपराधिक प्रक्रिया संहिता “जमानत” शब्द को परिभाषित नहीं करती है। आपराधिक प्रक्रिया संहिता की धारा 2 (ए) केवल “जमानती अपराध” और “गैर-जमानती अपराध” को परिभाषित करती है।
अपराधियों को उन मामलों में बांड पर रिहा होने का अधिकार है जब उन्होंने कुछ अपराध किए हैं। जबकि, अभियुक्त के पास जमानत का कोई स्वत: अधिकार नहीं है यदि उन पर ऐसे अपराध का आरोप लगाया जाता है जो जमानती नहीं है। बल्कि, पुरस्कार देना है या नहीं, इस पर अदालत का अंतिम कहना है।
आपराधिक प्रक्रिया संहिता की धारा 436 में “जमानती अपराधों” के मामलों में जमानत को संबोधित किया गया है। इसके लिए पुलिस अधिकारी और अदालत को प्रतिवादी को “पूर्ण और अपरिहार्य अधिकार के रूप में” बांड पर रिहा करने की आवश्यकता होती है, भले ही प्रतिवादी अपनी रिहाई का अनुरोध नहीं करता हो। उन्हें अभियुक्त को उसकी निजी मुचलके के आधार पर और किसी गारंटर की आवश्यकता के बिना जमानत पर मुक्त होने के उसके अधिकार के बारे में बताना चाहिए।
यदि प्रतिवादी निर्दिष्ट समय और स्थान पर अदालत में उपस्थित होने में विफल रहता है, जैसा कि जमानत बांड द्वारा आवश्यक है, तो अदालत धारा 436 (2) के तहत उसकी रिहाई को रद्द कर सकती है।
गैर-जमानती अपराध की स्थिति में धारा 437 में जमानत के प्रावधानों की चर्चा की गई है। इस प्रावधान के तहत आरोपी को स्वत: जमानत का कोई अधिकार नहीं है। फैसला पूरी तरह कोर्ट के अधिकार क्षेत्र में आता है।
जमानत देने से पहले अदालत निम्नलिखित बिंदुओं पर विचार करेगी:
कोर्ट जमानत देने के बाद गिरफ्तार व्यक्ति को पुलिस हिरासत से रिहा कर देगी। आपराधिक प्रक्रिया संहिता की धारा 437 और धारा 439 के अनुसार, एक आरोपी व्यक्ति साधारण जमानत के लिए याचिका दायर कर सकता है।
अभियुक्त की नियमित या अग्रिम ज़मानत की अर्जी जारी होने के दौरान उसे कुछ सांस लेने की जगह प्रदान करने के लिए, अदालत ने उसे अस्थायी और अल्पकालिक ज़मानत देने का सीधा आदेश जारी किया है।
सत्र या उच्च न्यायालय के सीधे आदेश पर गिरफ्तारी से पहले जमानत दी जाती है। अग्रिम जमानत का अनुरोध तब किया जाता है जब किसी व्यक्ति को डर हो कि उसे गिरफ्तार कर लिया जाएगा। अग्रिम जमानत के लिए एक आवेदन उलटा पड़ सकता है अगर यह अधिकारियों को सूचित करता है कि प्रतिवादी संभावित रूप से आपराधिक गतिविधियों में शामिल है।
आपराधिक प्रक्रिया संहिता की धारा 437(5) में उल्लिखित परिस्थितियों के तहत दी गई किसी भी जमानत को अदालत द्वारा रद्द किया जा सकता है। धारा 439(2) के तहत एक सत्र न्यायालय, उच्च न्यायालय या सर्वोच्च न्यायालय अपनी मर्जी से किसी भी समय जमानत रद्द कर सकता है और आरोपी व्यक्ति को हिरासत में भेज सकता है। एक अपीलीय अदालत धारा 389(2) के अनुसार आरोपी व्यक्ति की जमानत रद्द कर सकती है और गिरफ्तारी वारंट जारी कर सकती है।
