Natural justice does not refer solely to the kind of justice that can be found in nature. Whether or not they are codified in statute, the notions contained within have a strong resemblance to those of justice. Administrative discretion is subject to the full scope of natural justice. It’s intended use is to keep residents safe from management’s malicious intent and unfair treatment.
In India, the concept of “natural justice” refers to the rules established by the courts as the bare minimum necessary to protect an individual’s rights from being violated by the potentially arbitrary policies that a court or a quasi-court with administrative law power could adopt in issuing an order affecting those rights.
There are many places in the Constitution where the ideas of natural justice find solid footing. Article 21 of the Constitution, which establishes the concept of substantive and procedural due process, can be interpreted to include all the fairness inherent in the principles of natural justice whenever a person’s life or liberty is taken away without due process of law. The principles of natural justice are also incorporated in various contexts, specifically Article – 14. Class-based discrimination and other forms of state-sanctioned bias are both prohibited by Article – 14. Since arbitrariness arises whenever natural justice is compromised, Article 14’s Equality Clause might be considered violated when natural justice is compromised. The rights protected by Articles 14 and 21 of the Constitution require that the idea of natural justice not be completely disregarded by law.
There are mainly two Principles of Natural Justice. These two Principles are:
प्राकृतिक न्याय केवल उस प्रकार के न्याय को संदर्भित नहीं करता है जो प्रकृति में पाया जा सकता है। चाहे उन्हें क़ानून में संहिताबद्ध किया गया हो या नहीं, इसके भीतर निहित धारणाएं न्याय के समान हैं। प्रशासनिक विवेकाधिकार नैसर्गिक न्याय के पूर्ण दायरे के अधीन है। इसका उद्देश्य निवासियों को प्रबंधन के दुर्भावनापूर्ण इरादे और अनुचित व्यवहार से सुरक्षित रखना है।
भारत में, “प्राकृतिक न्याय” की अवधारणा अदालतों द्वारा स्थापित नियमों को संदर्भित करती है, जो किसी व्यक्ति के अधिकारों को संभावित मनमानी नीतियों के उल्लंघन से बचाने के लिए न्यूनतम आवश्यक है, जिसे एक अदालत या प्रशासनिक कानून शक्ति के साथ एक अर्ध-न्यायालय अपना सकता है। उन अधिकारों को प्रभावित करने वाला आदेश जारी करने में।
संविधान में ऐसे कई स्थान हैं जहां प्राकृतिक न्याय के विचारों को ठोस आधार मिलता है। संविधान के अनुच्छेद 21, जो मूल और प्रक्रियात्मक नियत प्रक्रिया की अवधारणा को स्थापित करता है, की व्याख्या प्राकृतिक न्याय के सिद्धांतों में निहित सभी निष्पक्षता को शामिल करने के लिए की जा सकती है, जब भी किसी व्यक्ति का जीवन या स्वतंत्रता कानून की उचित प्रक्रिया के बिना छीन ली जाती है। प्राकृतिक न्याय के सिद्धांतों को भी विभिन्न संदर्भों में शामिल किया गया है, विशेष रूप से अनुच्छेद – 14। वर्ग-आधारित भेदभाव और राज्य-स्वीकृत पूर्वाग्रह के अन्य रूप दोनों ही अनुच्छेद – 14 द्वारा निषिद्ध हैं। चूंकि प्राकृतिक न्याय से समझौता होने पर मनमानी उत्पन्न होती है, इसलिए अनुच्छेद 14 का समानता खंड जब प्राकृतिक न्याय से समझौता किया जाता है तो इसे उल्लंघन माना जा सकता है। संविधान के अनुच्छेद 14 और 21 द्वारा संरक्षित अधिकारों की आवश्यकता है कि प्राकृतिक न्याय के विचार को कानून द्वारा पूरी तरह से अवहेलना न किया जाए।
