What is Geographical Indication?

Geographical Indications (GI) refer to a designation assigned to a specific product originating from a particular geographical area, possessing unique qualities, reputation, or characteristics attributable to that place of origin. The GI system came into effect on September 15, 2003. Darjeeling Tea holds the distinction of being the first Indian product to receive a GI tag.

GI Tags play a vital role in intellectual property rights (IPRs), providing legal protection to products based on their geographical attributes. They ensure that GI-tagged products are not unlawfully used by others, granting them exclusive rights. Aspirants can find a comprehensive list of GI Tags awarded to various products to date in this article.

What are GI Tags in India?

Geographical Indications (GI) tags in India function as a means of intellectual property safeguarding, to protect goods associated with specific geographic areas. Regulated by the Geographical Indications of Goods (Registration and Protection) Act, 1999, these tags acknowledge products whose qualities, reputation, or characteristics are intricately linked to their geographical origin. They are bestowed upon various categories including foodstuffs, handicrafts, wine and spirit drinks, industrial products, and agricultural products. The inaugural product to receive a GI tag in India was Darjeeling tea in the year 2004-05.

Importance of GI Tags in India

  • Geographical indication rights empower authorized users to prevent third parties from using the indication if their products do not meet the specified standards.
  • For instance, under the protection of the Darjeeling geographical indication, producers of Darjeeling tea have the authority to refrain from using the term “Darjeeling” for tea that is not cultivated in their tea gardens or fails to adhere to the prescribed norms in the code of practice for the geographical indication.
  • It’s important to note that having a protected geographical indication doesn’t grant the holder the right to prohibit others from producing a product using the same methods outlined in the standards for that indication.
  • Typically, protection for a geographical indication tag is secured by obtaining rights over the sign representing the indication.

Benefits of GI Tags

  • The utilization of a Geographical Indication (GI) tag serves as a safeguard for the reputation and distinctiveness of a product, acting as a barrier against unauthorized use of its name or indication. This protective measure ensures consumers access genuine products while shielding producers from the adverse effects of counterfeiting.
  • An embedded GI tag contributes to enhanced marketability and better price realization for a product. By offering consumers a guarantee of quality and authenticity, especially crucial in international markets, it establishes a foundation for increased demand and premium pricing.
  • Beyond its impact on the market, GI tags play a vital role in fostering economic development. They endow producers with a competitive edge, drawing attention from tourists and potential investors to the specific region associated with the product.
  • Furthermore, the presence of GI tags can serve as a catalyst for innovation and creativity. Producers, incentivized by the protection provided, are encouraged to elevate the quality and distinctiveness of their products, contributing to ongoing advancements within their respective industries.

Protection of GI Tags

  • Safeguarding a geographical indicator (GI) empowers those authorized to use the indication to take legal action against unauthorized users seeking to benefit from its reputation, commonly known as “free-riders.”
  • The reputation of a geographical indicator is a substantial and intangible communal asset.
  • The Geographical Indications of Goods (Registration and Protection) Act of 1999 serves to protect GIs in India.
  • In India, the registration of GIs not only enhances legal protection but also streamlines the process of pursuing infringement cases, making it more accessible and effective.
