Injunction, Quantum Meruit & Burden of Proof | Important Terms for PCS (J) Preparation

Injunction

The term injunction is defined in section 36 of the Special Relief Act 1963. It basically refers to a formal court order prohibiting a party from taking a particular action. The main purpose of an injunction is to restore the status quo in all those situations where the presentation or omission of a certain action can cause enormous damage or harm to the other party. There can be different types of injunctions which are temporary  and permanent injunctions.

  • A temporary injunction is a court order that prohibits a party from taking a specific action for a specific period of time that may result in the violation of the other party’s legal rights.
  • A permanent injunction prohibits a party from permanently performing a certain act to protect the rights of another.

निषेधाज्ञा शब्द को विशेष राहत अधिनियम 1963 की धारा 36 में परिभाषित किया गया है। यह मूल रूप से एक औपचारिक अदालत के आदेश को संदर्भित करता है जो किसी पार्टी को एक विशेष कार्रवाई करने से रोकता है। निषेधाज्ञा का मुख्य उद्देश्य उन सभी स्थितियों में यथास्थिति को बहाल करना है जहां एक निश्चित कार्रवाई की प्रस्तुति या चूक दूसरे पक्ष को भारी नुकसान या नुकसान पहुंचा सकती है। विभिन्न प्रकार के निषेधाज्ञाएं हो सकती हैं जो अस्थायी और स्थायी निषेधाज्ञा हैं।

  • एक अस्थायी निषेधाज्ञा एक अदालती आदेश है जो एक पक्ष को एक विशिष्ट अवधि के लिए एक विशिष्ट कार्रवाई करने से रोकता है जिसके परिणामस्वरूप दूसरे पक्ष के कानूनी अधिकारों का उल्लंघन हो सकता है।
  • एक स्थायी निषेधाज्ञा एक पक्ष को दूसरे के अधिकारों की रक्षा के लिए एक निश्चित कार्य को स्थायी रूप से करने से रोकता है।

Quantum Meruit

Quantum Meruit is a term that basically means “as much as he deserves” or “as much as he has earned”. It basically means the actual value of  goods delivered or  services rendered. Sometimes one party to a contract prevents the other from fulfilling its obligations. In such a situation, one party suffers and receives nothing from the contract, while the other party enjoys the benefits. Therefore, they must compensate the other party for the part of the contract that they fulfilled, for any loss that they suffer from that contract.

These are some of the  remedies to which an injured party may be entitled. The main purpose of any medication is to bring both parties to the same level. This must always be kept in mind when deciding on possible remedies, both by the court and by the parties to the contract.

क्वांटम मेरिट एक शब्द है जिसका मूल रूप से अर्थ है “जितना वह योग्य है” या “जितना उसने अर्जित किया है”। इसका मूल रूप से अर्थ है वितरित माल या प्रदान की गई सेवाओं का वास्तविक मूल्य। कभी-कभी अनुबंध का एक पक्ष दूसरे को अपने दायित्वों को पूरा करने से रोकता है। ऐसी स्थिति में, एक पक्ष को अनुबंध से नुकसान होता है और कुछ भी प्राप्त नहीं होता है, जबकि दूसरे पक्ष को लाभ प्राप्त होता है। इसलिए, उन्हें अनुबंध के उस हिस्से के लिए दूसरे पक्ष की क्षतिपूर्ति करनी चाहिए जिसे उन्होंने पूरा किया, उस अनुबंध से होने वाले किसी भी नुकसान के लिए।

ये कुछ उपाय हैं जिनके लिए एक घायल पक्ष हकदार हो सकता है। किसी भी दवा का मुख्य उद्देश्य दोनों पक्षों को समान स्तर पर लाना होता है। अदालत और अनुबंध के पक्षकारों दोनों द्वारा संभावित उपायों पर निर्णय लेते समय इसे हमेशा ध्यान में रखा जाना चाहिए।

Burden of Proof

The parties to the trial make several claims during the trial. If both sides claim something, treating it as an established fact, they themselves must prove its validity and truth. This concept is known as “onus of proof” and is mentioned in Chapter VII of the Indian Evidence Act, 1872  which includes Sections 101 to  114A. It is considered the duty of the parties to bring to court only what they believe to be true and about which they can prove their belief beyond a reasonable doubt. This will be of great help to the court. Although Chapter VII does not mention the definition of the burden of proof, it specifies its requirements.

The burden of proof is usually on the prosecutor to prove that he suffered or was affected by an unreasonably incredible injury. Because they were prosecutors, it was believed that they could present the most imprudent evidence. On the other hand, in the case of heinous crimes, this burden shifts to the accused to prove his innocence. In some cases, the burden is shifted from one party to another, and in some cases, it rests with only one party.

Sections 101 to 103 of the Act deal with the burden of proof in general, while sections 104 to 106 deal with  certain special cases relating to a particular person.

मुकदमे के पक्षकार मुकदमे के दौरान कई दावे करते हैं। यदि दोनों पक्ष किसी बात का दावा करते हैं, तो उसे एक स्थापित तथ्य मानते हुए, उन्हें स्वयं इसकी वैधता और सच्चाई को साबित करना होगा। इस अवधारणा को “सबूत की जिम्मेदारी” के रूप में जाना जाता है और इसका उल्लेख भारतीय साक्ष्य अधिनियम, 1872 के अध्याय VII में किया गया है जिसमें धारा 101 से 114A शामिल है। यह पार्टियों का कर्तव्य माना जाता है कि वे केवल वही मानते हैं जो वे सत्य मानते हैं और जिसके बारे में वे अपने विश्वास को एक उचित संदेह से परे साबित कर सकते हैं। इससे कोर्ट को काफी मदद मिलेगी। हालांकि अध्याय VII में सबूत के बोझ की परिभाषा का उल्लेख नहीं है, यह इसकी आवश्यकताओं को निर्दिष्ट करता है।

सबूत का बोझ आमतौर पर अभियोजक पर होता है कि वह यह साबित करे कि वह अनुचित रूप से अविश्वसनीय चोट से पीड़ित था या प्रभावित हुआ था। क्योंकि वे अभियोजक थे, यह माना जाता था कि वे सबसे अविवेकी सबूत पेश कर सकते हैं। वहीं दूसरी ओर जघन्य अपराधों के मामले में यह बोझ आरोपी पर अपनी बेगुनाही साबित करने का होता है। कुछ मामलों में, बोझ को एक पार्टी से दूसरी पार्टी में स्थानांतरित कर दिया जाता है, और कुछ मामलों में, यह केवल एक पार्टी के साथ रहता है।

अधिनियम की धारा 101 से 103 सामान्य रूप से सबूत के बोझ से निपटती है, जबकि धारा 104 से 106 किसी विशेष व्यक्ति से संबंधित कुछ विशेष मामलों से संबंधित है।
