The matter of hijab ban escalated when 6 female students at Udupi’s Government PU College for Girls were barred from attending classes while wearing the hijab. After this the students staged a protest. Consecutively the students filed Writ Petition in Karnataka High Court. After which violence escalated between hijab supporters and right-wing organizations. The schools and universities were shutdown and curfew was enforced. In light of which the Karnataka Government issued an order stating that students have to comply with the uniform/dress code prescribed by College Development Committees.
Further, the Karnataka High Court dismissed Petitions seeking permission for wearing hijab in school and university stating that wearing the hijab is not an essential religious practice in Islam. The High Court also opined the freedom of religion under Article 25 of the Constitution is subject to reasonable restriction. After this ruling a group of petitions was filed in Supreme Court against the Karnataka High Court ruling on hijab ban.
The bench of Justices Hemant Gupta and Sudhanshu Dhulia heard several parties in the matter over 10 days and on September 22 reserved its judgment. The Supreme Court on 13th October 2022 delivered a split verdict on petitions. The 26 appeals against the Karnataka High Court’s decision that the hijab was not a fundamental Islamic practise and that the wearing of a headscarf in educational institutions inside the State was prohibited were dismissed by Justice Hemant Gupta. On the other hand, Justice Sudhanshu Dhulia overturned the Karnataka High Court’s decision and declared that the dispute did not revolve on the idea of essential religious practise in its entirety.
According to Justice Hemant Gupta, allowing one community to wear religious symbols to school will be the contrary to secularism. He emphasised that equality and discipline are crucial components of a secular institution in a multicultural society and declared that the government is not in violation of the constitution when it enforces a required uniform and “constitutional goal of fraternity would be defeated if students are permitted to carry their apparent religious symbols with them to the classroom”. The government order, according to Justice Gupta, “promotes an equal atmosphere” and do not infringe the constitutional promise of fraternity and dignity, rather it encourages an equal environment in which such fraternal principles can be ingrained and cultivated without obstruction of any sort.
In contrast, Justice Sudhanshu Dhulia held that demanding to remove a head scarf at an institution’s gates constitutes a breach of their dignity and privacy. The question is why a head-scarf that does not conflict with the uniform cannot be worn as a matter of choice without being subjected to hostile discrimination; and whether the hijab will be employed to restrict girl students their access to an education. Justice Dhulia asserted that discipline should not come at the expense of freedom, and also he wondered that why a girl child wearing a hijab should be a public order problem. He further declared that “reasonable accommodation’ of this practise will be a sign of a mature society”. He particularly empathised with female students who overcome higher hurdles than boys to obtain an education. Furthermore, Justice Dhulia clarified that, under Indian constitutional law, wearing a hijab should be purely optional. It should be subjected to conscience, belief, and expression, whether or not it is a concern of essential religious practise.
According to Justice Dhulia, a school is a public space, and drawing a link between a school and a jail or military camp is incorrect. He went on to say that school is the period when pupils realise that diversity is India’s strength, “now is the time to learn not to be alarmed by the country’s diversity, but to embrace and celebrate it.”
The courts are not well-suited to handle “theological questions” for a variety of reasons, but perhaps most importantly, because there will always be more than one point of view on a particular religious question, and nothing gives the Court the power to select one over the other. However, Justice Dhulia stated that the courts must intervene when the Constitution’s bounds are violated or unreasonable restrictions are imposed.
In view of the divergent views expressed by the Bench, the matter is now placed before the Chief Justice of India for constitution of an appropriate Bench.
हिजाब बैन का मामला
हिजाब बैन का मामला तब और बढ़ गया जब उडुपी के गवर्नमेंट पीयू कॉलेज फॉर गर्ल्स में 6 छात्राओं को हिजाब पहनकर क्लास में जाने से रोक दिया गया. इसके बाद छात्रों ने धरना प्रदर्शन किया। जिसके खिलाफ़ छात्रों ने कर्नाटक उच्च न्यायालय में रिट याचिका दायर की। जिसके बाद हिजाब समर्थकों और दक्षिणपंथी संगठनों के बीच हिंसा तेज हो गई. स्कूलों और विश्वविद्यालयों को बंद कर दिया गया और कर्फ्यू लागू कर दिया गया। जिसके आलोक में कर्नाटक सरकार ने एक आदेश जारी कर कहा कि छात्रों को कॉलेज विकास समितियों द्वारा निर्धारित वर्दी/ड्रेस कोड का पालन करना होगा।
इसके अलावा, कर्नाटक उच्च न्यायालय ने स्कूल और विश्वविद्यालय में हिजाब पहनने की अनुमति मांगने वाली याचिकाओं को यह कहते हुए खारिज कर दिया कि हिजाब पहनना इस्लाम में एक आवश्यक धार्मिक प्रथा नहीं है। उच्च न्यायालय ने यह भी कहा कि संविधान के अनुच्छेद 25 के तहत धर्म की स्वतंत्रता उचित प्रतिबंध के अधीन है। इस फैसले के बाद कर्नाटक हाई कोर्ट के हिजाब बैन के फैसले के खिलाफ सुप्रीम कोर्ट में याचिकाओं का एक समूह दायर किया गया था।
जस्टिस हेमंत गुप्ता और जस्टिस सुधांशु धूलिया की बेंच ने 10 दिनों में कई पक्षों को सुना और 22 सितंबर को अपना फैसला सुरक्षित रख लिया। सुप्रीम कोर्ट ने 13 अक्टूबर 2022 को याचिकाओं पर विभाजित फैसला सुनाया। कर्नाटक उच्च न्यायालय के फैसले के खिलाफ 26 अपीलें कि हिजाब एक मौलिक इस्लामी प्रथा नहीं थी और राज्य के अंदर शैक्षणिक संस्थानों में हेडस्कार्फ़ पहनना प्रतिबंधित था, न्यायमूर्ति हेमंत गुप्ता द्वारा खारिज कर दिया गया था। दूसरी ओर, न्यायमूर्ति सुधांशु धूलिया ने कर्नाटक उच्च न्यायालय के फैसले को पलट दिया और घोषणा की कि विवाद पूरी तरह से आवश्यक धार्मिक अभ्यास के विचार पर नहीं घूमता है।
न्यायमूर्ति हेमंत गुप्ता के अनुसार, एक समुदाय को धार्मिक प्रतीकों को स्कूल में पहनने की अनुमति देना धर्मनिरपेक्षता के विपरीत होगा। उन्होंने जोर देकर कहा कि समानता और अनुशासन एक बहुसांस्कृतिक समाज में एक धर्मनिरपेक्ष संस्थान के महत्वपूर्ण घटक हैं और घोषणा की कि सरकार संविधान का उल्लंघन नहीं कर रही है जब वह एक आवश्यक वर्दी लागू करती है और “यदि छात्रों को ले जाने की अनुमति दी जाती है तो बंधुत्व का संवैधानिक लक्ष्य पराजित हो जाएगा। कक्षा में उनके साथ उनके स्पष्ट धार्मिक प्रतीक ”। जस्टिस गुप्ता के अनुसार, सरकारी आदेश, “एक समान माहौल को बढ़ावा देता है” और बंधुत्व और गरिमा के संवैधानिक वादे का उल्लंघन नहीं करता है, बल्कि यह एक समान वातावरण को प्रोत्साहित करता है जिसमें इस तरह के भ्रातृ सिद्धांतों को किसी भी प्रकार की बाधा के बिना शामिल किया जा सकता है।
इसके विपरीत, न्यायमूर्ति सुधांशु धूलिया ने कहा कि किसी संस्थान के द्वार पर सिर का हीजब हटाने की मांग करना उनकी गरिमा और निजता का उल्लंघन है। सवाल यह है कि एक सिर पर हीजब जो वर्दी के साथ संघर्ष नहीं करता है, उसे शत्रुतापूर्ण भेदभाव के बिना पसंद के मामले के रूप में नहीं पहना जा सकता है; और क्या हिजाब को छात्राओं की शिक्षा तक उनकी पहुंच को प्रतिबंधित करने के लिए नियोजित किया जाएगा। न्यायमूर्ति धूलिया ने जोर देकर कहा कि स्वतंत्रता की कीमत पर अनुशासन नहीं आना चाहिए, और उन्होंने यह भी सोचा कि हिजाब पहनने वाली एक लड़की सार्वजनिक व्यवस्था की समस्या क्यों होनी चाहिए। उन्होंने आगे घोषणा की कि इस प्रथा का “उचित समायोजन’ एक परिपक्व समाज का संकेत होगा”। उन्होंने विशेष रूप से उन छात्राओं के प्रति सहानुभूति व्यक्त की जो शिक्षा प्राप्त करने के लिए लड़कों की तुलना में उच्च बाधाओं को पार करती हैं। इसके अलावा, न्यायमूर्ति धूलिया ने स्पष्ट किया कि, भारतीय संवैधानिक कानून के तहत, हिजाब पहनना पूरी तरह से वैकल्पिक होना चाहिए। यह विवेक, विश्वास और अभिव्यक्ति के अधीन होना चाहिए, चाहे वह आवश्यक धार्मिक अभ्यास की चिंता हो या नहीं।
न्यायमूर्ति धूलिया के अनुसार, एक स्कूल एक सार्वजनिक स्थान है, और एक स्कूल और एक जेल या सैन्य शिविर के बीच एक कड़ी बनाना गलत है। उन्होंने आगे कहा कि स्कूल वह अवधि है जब विद्यार्थियों को यह एहसास होता है कि विविधता भारत की ताकत है, “अब यह सीखने का समय है कि देश की विविधता से घबराना नहीं, बल्कि इसे गले लगाना और इसका जश्न मनाना है।”
अदालतें कई कारणों से “धार्मिक प्रश्नों” को संभालने के लिए उपयुक्त नहीं हैं, लेकिन शायद सबसे महत्वपूर्ण बात यह है कि किसी विशेष धार्मिक प्रश्न पर हमेशा एक से अधिक दृष्टिकोण होंगे, और कुछ भी न्यायालय को चयन करने की शक्ति नहीं देता है। हालांकि, न्यायमूर्ति धूलिया ने कहा कि जब संविधान की सीमाओं का उल्लंघन होता है या अनुचित प्रतिबंध लगाए जाते हैं तो अदालतों को हस्तक्षेप करना चाहिए।
बेंच द्वारा व्यक्त किए गए अलग-अलग विचारों को देखते हुए, मामले को अब एक उपयुक्त बेंच के गठन के लिए भारत के मुख्य न्यायाधीश के समक्ष रखा गया है।
