What is Constitutionalism?

Constitutionalism is the belief that every nation or state should be ruled in accordance with its founding charter, or set of rules. A country’s constitution is the supreme law of that nation, outlining the precise norms and procedures that must be followed by all citizens. For a democratic system to function properly, the guiding concept of constitutionalism is crucial. It guarantees that personal liberties are prioritised and that citizens’ rights are protected against state intrusion. It keeps the government in check and stops it from abusing its power in a democratic system.

Constitutionalism in India

Constitutional principles are embedded in a number of articles and amendments of Constitution of India.

  1. The Indian Constitution defines the nature and organisation of the Indian state in addition to guaranteeing the rights and protections of its citizens. Therefore, it is equally true that the Indian Constitution restricts the reach and authority of the Indian State.
  2. Article 21 of the Indian Constitution states that no person shall be deprived of life or liberty except in accordance with the due process of law. This means that a person’s life and freedom cannot be taken without due process of law.
  3. All other protections against the abuse of state power are secondary to the protections afforded by the protections of fundamental rights. As limitations on governmental power, fundamental rights tell governments precisely what they mustn’t do. They provide the function of a negative covenant for the state.
  4. The Indian State is governed and constrained by the Indian Constitution, which is written, codified, and recognised as the highest law of the land. Limited insofar as it is constrained by and must adhere to the Indian Constitution’s stipulations. Part IV of the Indian Constitution lays forth the Directive Principles of State Policy that the government must adhere to.
  5. According to the principle of separation of powers, legislative, executive, and judicial branches of government are each given their own distinct responsibilities and authority. Each organ is constrained from exceeding its sphere of authority, and the system guarantees a check on the power of the other, preventing them from acting arbitrarily and unjustly, without regard to due process.

संविधानवाद क्या है?

संविधानवाद यह विश्वास है कि प्रत्येक राष्ट्र या राज्य को उसके संस्थापक चार्टर, या नियमों के सेट के अनुसार शासित किया जाना चाहिए। एक देश का संविधान उस देश का सर्वोच्च कानून होता है, जो सभी नागरिकों द्वारा पालन किए जाने वाले सटीक मानदंडों और प्रक्रियाओं को रेखांकित करता है। एक लोकतांत्रिक प्रणाली के ठीक से काम करने के लिए, संवैधानिकता की मार्गदर्शक अवधारणा महत्वपूर्ण है। यह गारंटी देता है कि व्यक्तिगत स्वतंत्रता को प्राथमिकता दी जाती है और नागरिकों के अधिकारों को राज्य की घुसपैठ के खिलाफ संरक्षित किया जाता है। यह सरकार को नियंत्रण में रखता है और उसे लोकतांत्रिक व्यवस्था में अपनी शक्ति का दुरुपयोग करने से रोकता है।

संविधानवाद के सिद्धांत

भारत में संविधानवाद

संवैधानिक सिद्धांत भारत के संविधान के कई लेखों और संशोधनों में अंतर्निहित हैं।

  1. भारतीय संविधान अपने नागरिकों के अधिकारों और सुरक्षा की गारंटी के अलावा भारतीय राज्य की प्रकृति और संगठन को परिभाषित करता है। इसलिए, यह भी उतना ही सच है कि भारतीय संविधान भारतीय राज्य की पहुंच और अधिकार को प्रतिबंधित करता है।
  2. भारतीय संविधान के अनुच्छेद 21 में कहा गया है कि कानून की उचित प्रक्रिया के अनुसार किसी भी व्यक्ति को जीवन या स्वतंत्रता से वंचित नहीं किया जाएगा। इसका मतलब यह है कि कानून की उचित प्रक्रिया के बिना किसी व्यक्ति का जीवन और स्वतंत्रता नहीं ली जा सकती है।
  3. राज्य की शक्ति के दुरुपयोग के खिलाफ अन्य सभी सुरक्षा मौलिक अधिकारों के संरक्षण द्वारा प्रदान की जाने वाली सुरक्षा के लिए माध्यमिक हैं। सरकारी शक्ति की सीमाओं के रूप में, मौलिक अधिकार सरकारों को ठीक-ठीक बताते हैं कि उन्हें क्या नहीं करना चाहिए। वे राज्य के लिए एक नकारात्मक वाचा का कार्य प्रदान करते हैं।
  4. भारतीय राज्य भारतीय संविधान द्वारा शासित और विवश है, जो लिखित, संहिताबद्ध और देश के सर्वोच्च कानून के रूप में मान्यता प्राप्त है। सीमित जहाँ तक यह भारतीय संविधान की शर्तों द्वारा विवश है और इसका पालन करना चाहिए। भारतीय संविधान का भाग IV राज्य के नीति निर्देशक सिद्धांतों को बताता है जिनका सरकार को पालन करना चाहिए।
  5. शक्तियों के पृथक्करण के सिद्धांत के अनुसार, सरकार की विधायी, कार्यकारी और न्यायिक शाखाओं में से प्रत्येक को अपनी अलग जिम्मेदारियाँ और अधिकार दिए गए हैं। प्रत्येक अंग अपने अधिकार क्षेत्र को पार करने से विवश है, और सिस्टम दूसरे की शक्ति पर एक जांच की गारंटी देता है, उन्हें उचित प्रक्रिया की परवाह किए बिना मनमाने और अन्यायपूर्ण कार्य करने से रोकता है।
