What is Unlawful Activities (Prevention) Act, 1967?

Threats to India’s territorial integrity and political independence are specifically targeted under the Unlawful Activities (Prevention) Act, 1967 (UAPA), which seeks to criminalise and deter similar behaviour. Furthermore, it grants the central government broad authority to label groups as terrorist organisations and establishes severe punishments for anybody who support or join such groups.

Even though the Act has been there since 1967, it wasn’t until the UAPA Amendment Act of 2004 that Parliament added a specific Chapter to penalise terrorist crimes (Chapter IV). In the years that followed, in 2008 and 2013, additional changes were made to the law.

Terrorist and Disruptive Activities (Prevention) Act, 1987 (‘TADA’) and Prevention of Terrorism Act, 2002 (‘POTA’) were the primary pieces of legislation addressing terrorism before UAPA was modified. The constitutionality of both TADA and POTA have been contested throughout the years.

Important Provisions under the UAPA Act

According to the UAPA, a group is considered a “unlawful association” if it meets the following criteria:

(i) commits or participates in acts of terrorism,

(ii) prepares for terrorism,

(iii) promotes terrorism, or

(iv) is otherwise involved in terrorism.

The government can then issue a notification designating such an organisation as a terrorist organisation, if it believes that the organisation is part of “terrorist activities.”

Both the death sentence and life imprisonment are possible outcomes for violating UAPA. The Act grants the central government unchecked authority, so that it can make any action illegal by publishing a proclamation in the Official Gazette.

In order to seize property suspected of having ties to terrorism, an investigating officer must first get permission from the Director-General of Police, as per the Act. The Bill specifies that the consent of the Director-General of the National Inquiry Agency (NIA) must be obtained prior to the seizure of such property if the investigation is being undertaken by an officer of the NIA.

Officers of the level of Deputy Superintendent or Assistant Commissioner of Police, or higher, are authorised to undertake investigations under the Act. The Bill also gives NIA officers with the level of Inspector or higher the authority to conduct criminal investigations.

Terrorism is broadly defined in the Act to encompass violations of any of the treaties that are specified in an schedule to the Act. Of the nine treaties listed in the Schedule, two are particularly relevant here: the Convention for the Suppression of Terrorist Bombings (1997) and the Convention against the Taking of Hostages (1996). (1979). The International Convention for the Suppression of Acts of Nuclear Terrorism is an additional treaty that will be added to this list as a result of this legislation.

Landmark Cases on UAPA

Section 10 of UAPA and Section 3(5) of TADA, which deemed simple participation in a banned organisation illegal, were both struck down by the court in Sri Indra Das v. State of Assam. The Court ruled that if these clauses were taken at face value, they would run afoul of Constitutional Articles 19 and 21. This was in keeping with the previous judgement in Arup Bhuyan’s case, where the Court found that “simple membership of a banned organisation would not render a person a criminal until he resorts to violence or incites people to violence or produces public disturbance by violence or incitement to violence.”

In National Investigation Agency v. Zahoor Ahmad Shah Watali (2019) 5 SCC 1, the Supreme Court ruled that, in accordance with Section 43(D)(5) of the UAPA, bail might be denied if evidence was presented showing the accused’s involvement in terrorist activities of any kind. By including the words “any other means of whatsoever sort,” the government can classify any action as a terrorist act.

A defendant charged under the UAPA was granted bail in Union of India v. K. A. Najeeb. As a result of this case, the Court no longer hesitates to issue bail despite the strict anti-terror statutes that apply. Bail may be granted based on a violation of a defendant’s constitutional rights, the court ruled. In the event of a lengthy delay in a trial, bail must be granted, even if the case is subject to strict criminal legislation such as anti-terror statutes.

यूएपीए अधिनियम के तहत महत्वपूर्ण प्रावधान

यूएपीए के अनुसार, एक समूह को “गैरकानूनी संघ” माना जाता है यदि वह निम्नलिखित मानदंडों को पूरा करता है:

(i) आतंकवाद के कृत्यों को करता है या उनमें भाग लेता है,

(ii) आतंकवाद के लिए तैयार करता है,

(iii) आतंकवाद को बढ़ावा देता है, या

(iv) अन्यथा आतंकवाद में शामिल है।

सरकार तब ऐसे संगठन को आतंकवादी संगठन के रूप में नामित करने वाली एक अधिसूचना जारी कर सकती है, अगर उसे लगता है कि संगठन “आतंकवादी गतिविधियों” का हिस्सा है।

पुलिस उपाधीक्षक या सहायक पुलिस आयुक्त या उससे ऊपर के स्तर के अधिकारी अधिनियम के तहत जांच करने के लिए अधिकृत हैं। बिल इंस्पेक्टर या उससे ऊपर के स्तर के एनआईए अधिकारियों को आपराधिक जांच करने का अधिकार भी देता है।

अधिनियम की अनुसूची में निर्दिष्ट किसी भी संधि के उल्लंघन को शामिल करने के लिए आतंकवाद को अधिनियम में व्यापक रूप से परिभाषित किया गया है। अनुसूची में सूचीबद्ध नौ संधियों में से दो यहां विशेष रूप से प्रासंगिक हैं: आतंकवादी बमबारी के दमन के लिए कन्वेंशन (1997) और बंधकों को लेने के खिलाफ कन्वेंशन (1996)। (1979)। परमाणु आतंकवाद के कृत्यों के दमन के लिए अंतर्राष्ट्रीय सम्मेलन एक अतिरिक्त संधि है जिसे इस कानून के परिणामस्वरूप इस सूची में जोड़ा जाएगा।

यूएपीए पर ऐतिहासिक मामले

राष्ट्रीय जांच एजेंसी बनाम जहूर अहमद शाह वटाली (2019) 5 एससीसी 1 में, सुप्रीम कोर्ट ने फैसला सुनाया कि, यूएपीए की धारा 43(डी)(5) के अनुसार, अगर आरोपी की संलिप्तता दिखाने वाले सबूत पेश किए गए तो जमानत से इनकार किया जा सकता है किसी भी प्रकार की आतंकवादी गतिविधियों में “किसी भी प्रकार का कोई अन्य साधन” शब्दों को शामिल करके, सरकार किसी भी कार्रवाई को आतंकवादी कृत्य के रूप में वर्गीकृत कर सकती है।

यूएपीए के तहत आरोपित एक प्रतिवादी को यूनियन ऑफ इंडिया बनाम के.ए. नजीब के मामले में जमानत दे दी गई। इस मामले के परिणामस्वरूप, लागू होने वाले सख्त आतंकवाद विरोधी कानूनों के बावजूद अदालत अब ज़मानत जारी करने में संकोच नहीं करती है। अदालत ने फैसला सुनाया कि प्रतिवादी के संवैधानिक अधिकारों के उल्लंघन के आधार पर जमानत दी जा सकती है। मुकदमे में लंबी देरी की स्थिति में, जमानत दी जानी चाहिए, भले ही मामला सख्त आपराधिक कानून जैसे आतंकवाद विरोधी कानूनों के अधीन हो।
