- Be a citizen of India, or
- Be a subject of Nepal, or
- Be a subject of Bhutan, or

- Be a person of Indian origin who has migrated from Pakistan, Burma, Sri Lanka, Kenya, Uganda, Tanzania, Zambia, Malawi, Zaire, Ethiopia, or Vietnam, intending to settle permanently in India.
