February 2022: The Delhi High Court reserved judgment on a series of Public Interest Litigations (PILs) challenging the exception related to marital rape in Section 375 of the Indian Penal Code (IPC).
Section 375 IPC: Defines the offense of rape in India.
Exception: Exception 2 to Section 375 of IPC states "non-consensual sexual intercourse by a man with his wife, if she is over 15 years, does not amount to rape". Thus, coercive and non-consensual intercourse by a husband with his wife (above 15 years of age) is outside the ambit of rape.
Challenge: The PILs argued that this exception is unconstitutional and violates the rights of married women by denying them the same protection against rape that unmarried women receive.
