The Negotiable Instruments Act 1881

In 1881, the Negotiable Instruments Act was passed to facilitate the expansion of banking and trade. The main goal was to make the use of negotiable instruments legitimate. The purpose of the Negotiable Instruments Act 1881 is to establish the legal framework for the current nationwide system of negotiable instruments. The system would be systematically organised by the regulatory laws, and a final authority to decide any issues involving negotiable instruments would be defined by the Negotiable Instruments Act 1881.

There is greater clarity and understanding thanks to the definitions provided by the Negotiable Instruments Act 1881. Identifying information, such as the drawer, drawee, acceptor, etc., is included in the appropriate sections.

The penal provisions for effective implementation of the negotiable instruments process between the parties are provided by the Negotiable Instruments Act 1881. There may be criminal charges brought against any party whose obligations are not met, or who fails to fulfil any such duty.

What is a Negotiable Instrument?

Instrument refers to “a written document by which a right is created in favour of some person or persons” and negotiable means “transferable by delivery.” This means that a negotiable instrument is any written document that confers a right in favour of a third party and can be freely transferred. Money claims on paper that can be transferred from one person to another through physical delivery or endorsement and delivery are called negotiable instruments. You can use a promissory note, a check, a bill of exchange, a dividend certificate, a warrant, a bill of sale, a bill of exchange, a receipt from the railroad, a bill of sale for goods, a certificate for railway bonds, etc.

There are certain requirements that must be met before an instrument can be considered a negotiable instrument under the terms of the Negotiable Instruments Act 1881.

  • Every transaction involving negotiable instruments would be documented in writing because all necessary negotiable instrument documents would be held by the respective parties. Depending on the type of negotiable instrument (promissory note, bill of exchange, check, etc.), the rules may be different. Any agreements reached orally between the parties are void and of no force or effect in the event of a dispute. In the event of a dispute between the parties, a written document can be used as prima facie evidence in a court of law to explain the facts.
  • Without the parties’ signatures validating the instrument, it has no legal effect. The symbol attests to the parties’ legal agreement to the settlement terms. That’s why it’s so important for everyone involved to sign an instrument properly.
  • All transactions with negotiable instruments must be conducted in lawful and official national currency. The sole purpose of these negotiable instruments would be to facilitate the exchange of legal tender money. It must be conducted solely in monetary terms, as the validity of the products or other transactions would be compromised otherwise.
  • For one, “this system is very popular in business and other commercial transactions” right now, thanks to rising demand. This method of payment and settlement is secure and easy for all involved. Since the money would be wired to the recipient in accordance with the regulations governing financial transactions, no physical currency would be exchanged.
  • Convenient transaction methods and an effective system are both necessary for progress and growth, which is why the former is a prerequisite for the latter. Because of the reliability of the banking system and the security of the system, the money would be transferred quickly and accurately.

Salient features of Negotiable Instruments Act 1881

  • Section 13 of the Negotiable Instruments Act states that a negotiable instrument is a promissory note, bill of exchange or a cheque payable either to order or to bearer. Negotiable instruments recognised by statute are: (i) Promissory notes (ii) Bills of exchange (iii) Cheques. Negotiable instruments recognised by usage or custom are: (i) Hundis (ii) Share warrants (iii) Dividend warrants (iv) Bankers draft (v) Circular notes (vi) Bearer debentures (vii) Debentures of Bombay Port Trust (viii) Railway receipts (ix) Delivery orders.
  • According to section 14 of the Act, ‘when a promissory note, bill of exchange or cheque is transferred to any person so as to constitute that person the holder thereof, the instrument is said to be negotiated.’
  • Section 138 of the Negotiable Instruments Act 1881 discusses Dishonor of cheque for insufficiency of funds in the accounts and penalties for the same, and sections 138 and 142 of the act cover other aspects of dishonour of cheques and related laws.
  • Presumptions that a check was written to pay off a debt or liability are based on Sections 118 and 139 of the Negotiable Instruments Act. But the defence can refute it through cross-examination even if the witness isn’t called to the stand. The burden of proof remains on the complainant to establish that the cheque was issued in settlement of a debt or liability that is enforceable under law. A defendant would have a heavier burden to bear in such a case than in those brought under section114 of the Evidence Act.

 परक्राम्य लिखत अधिनियम 1881 की मुख्य विशेषताएं

  • परक्राम्य लिखत अधिनियम की धारा 13 में कहा गया है कि एक परक्राम्य लिखत एक वचन पत्र, विनिमय का बिल या एक चेक है जो या तो आदेश देने के लिए या धारक को देय है। क़ानून द्वारा मान्यता प्राप्त परक्राम्य लिखत हैं: (i) वचन पत्र (ii) विनिमय के बिल (iii) चेक। उपयोग या प्रथा द्वारा मान्यता प्राप्त परक्राम्य लिखत हैं: (i) हुंडी (ii) शेयर वारंट (iii) लाभांश वारंट (iv) बैंकर्स ड्राफ्ट (v) सर्कुलर नोट (vi) बियरर डिबेंचर (vii) बॉम्बे पोर्ट ट्रस्ट के डिबेंचर (viii) रेलवे रसीदें (ix) सुपुर्दगी आदेश।
  • अधिनियम की धारा 14 के अनुसार, ‘जब एक वचन पत्र, विनिमय बिल या चेक किसी व्यक्ति को स्थानांतरित किया जाता है ताकि वह व्यक्ति उसका धारक बन सके, तो लिखत को निगोशिएटेड कहा जाता है।’
  • नेगोशिएबल इंस्ट्रूमेंट्स एक्ट 1881 की धारा 138 खातों में अपर्याप्त राशि के लिए चेक के अनादरण और उसके लिए जुर्माने की चर्चा करती है, और अधिनियम की धारा 138 और 142 में चेक और संबंधित कानूनों के अनादरण के अन्य पहलुओं को शामिल किया गया है।
