Registration of Trade Union

The rules for the registration of trade unions are outlined in Chapter II of the Trade Unions Act, 1926. According to section 2 (h) of the Act, “Trade Union” means “any combination, whether temporary or permanent, formed primarily for the purpose of regulating the relations between workmen and employers or between workmen and workmen, or between employers and employers, or for imposing restrictive conditions on the conduct of any trade or business, and includes any federation of two or more Trade Unions.”

Having a union recognised by the government is one of the many benefits of being a registered union.

Important Provisions for Registration of Trade Union under Trade Union Act, 1926

  1. A registrar is designated for the Trade Union registration process per Section 3. If the trade union registrar for a given state is unable to carry out his or her duties, the appropriate government may appoint a replacement.
  2. Section 4 of the Act states that any seven or more members of a Trade Union in compliance with the requirements of the Act may file an application for registration of the Trade Union. Secondarily, no trade union of workmen shall be registered unless on the date of making its application, a minimum of seven of its members who are workmen are employed in the establishment or industry. This requirement is in addition to the first, which states that no trade union of workmen shall be registered unless at least 10% or 100 of the workmen, whichever is less, engaged in the employment of the establishment are its members.
  3. A trade union’s application to the registrar must include the following information in accordance with Section 5:
  • the names, occupations, and addresses of all members making the application;
  • the name of the trade union and the location of its principal office; and
  • the titles, names, ages, addresses, and occupations of the trade union’s office-bearers.
  1. Section 6 of the Act states that a Trade Union is not eligible for registration under the Act if it has not complied with the Act’s requirements and rules.
  2. In order to determine whether or not all of the details are in conformity with sections 5 and 6 of the Act, the registrar may, per section 7 of the Act, request more information.
  3. According to Section 8 of the Act, the Trade Union shall be registered by the Registrar if the Registrar is satisfied that the Trade Union has met all conditions of the Act with respect to the registration.
  4. Section 9 of the Act mandates that the registrar will provide the trade union with a certificate of registration.

By providing a forum for workers to voice their concerns and get representation, trade unions help to foster a positive environment in the workplace.

ट्रेड यूनियन का पंजीकरण

ट्रेड यूनियनों के पंजीकरण के नियमों को ट्रेड यूनियन अधिनियम, 1926 के अध्याय II में उल्लिखित किया गया है। अधिनियम की धारा 2 (एच) के अनुसार, “ट्रेड यूनियन” का अर्थ है “कोई भी संयोजन, चाहे अस्थायी या स्थायी, मुख्य रूप से कामगारों और नियोक्ताओं के बीच या कामगारों और कामगारों के बीच, या नियोक्ताओं और नियोक्ताओं के बीच संबंधों को विनियमित करने के उद्देश्य से, या किसी भी व्यापार या व्यवसाय के संचालन पर प्रतिबंधात्मक शर्तें लगाने के लिए, और इसमें दो या अधिक ट्रेड यूनियनों का कोई भी संघ शामिल है।

सरकार द्वारा मान्यता प्राप्त संघ होना एक पंजीकृत संघ होने के कई लाभों में से एक है।

ट्रेड यूनियन अधिनियम, 1926 के तहत ट्रेड यूनियन के पंजीकरण के लिए महत्वपूर्ण प्रावधान

  1. एक रजिस्ट्रार को ट्रेड यूनियन पंजीकरण प्रक्रिया के लिए धारा 3 के अनुसार नामित किया गया है। यदि किसी दिए गए राज्य के लिए ट्रेड यूनियन रजिस्ट्रार अपने कर्तव्यों को पूरा करने में असमर्थ है, तो उपयुक्त सरकार एक प्रतिस्थापन की नियुक्ति कर सकती है।
  2. अधिनियम की धारा 4 में कहा गया है कि एक ट्रेड यूनियन के सात या अधिक सदस्य अधिनियम की आवश्यकताओं के अनुपालन में ट्रेड यूनियन के पंजीकरण के लिए आवेदन दाखिल कर सकते हैं। दूसरे, कामगारों का कोई भी ट्रेड यूनियन तब तक पंजीकृत नहीं किया जाएगा जब तक कि उसके आवेदन करने की तारीख तक, उसके कम से कम सात सदस्य जो कामगार हैं, स्थापना या उद्योग में कार्यरत नहीं हैं। यह आवश्यकता पहले के अतिरिक्त है, जिसमें कहा गया है कि कामगारों का कोई भी ट्रेड यूनियन तब तक पंजीकृत नहीं किया जाएगा जब तक कि कम से कम 10% या 100 कामगार, जो भी कम हो, स्थापना के रोजगार में लगे हों, इसके सदस्य नहीं हैं।
  3. रजिस्ट्रार को एक ट्रेड यूनियन के आवेदन में धारा 5 के अनुसार निम्नलिखित जानकारी शामिल होनी चाहिए:
  • आवेदन करने वाले सभी सदस्यों के नाम, व्यवसाय और पते;
  • ट्रेड यूनियन का नाम और उसके प्रधान कार्यालय का स्थान; तथा
  • ट्रेड यूनियन के पदाधिकारियों के शीर्षक, नाम, उम्र, पते और व्यवसाय।
  1. अधिनियम की धारा 6 में कहा गया है कि एक ट्रेड यूनियन अधिनियम के तहत पंजीकरण के लिए पात्र नहीं है यदि उसने अधिनियम की आवश्यकताओं और नियमों का अनुपालन नहीं किया है।
  2. यह निर्धारित करने के लिए कि सभी विवरण अधिनियम की धारा 5 और 6 के अनुरूप हैं या नहीं, रजिस्ट्रार, अधिनियम की धारा 7 के अनुसार, अधिक जानकारी का अनुरोध कर सकता है।
  3. अधिनियम की धारा 8 के अनुसार, ट्रेड यूनियन को रजिस्ट्रार द्वारा पंजीकृत किया जाएगा यदि रजिस्ट्रार संतुष्ट है कि ट्रेड यूनियन ने पंजीकरण के संबंध में अधिनियम की सभी शर्तों को पूरा किया है।
  4. अधिनियम की धारा 9 में कहा गया है कि रजिस्ट्रार ट्रेड यूनियन को पंजीकरण का प्रमाण पत्र प्रदान करेगा।
