Importance of domestic violence act 2005: The Protection of Women from Domestic Violence Act, 2005 was enacted in India to protect women from domestic violence in an effort to streamline the country’s legal framework, both procedurally and substantively. In the case of Indra Sarma v. V.K.V Sarma, (2013) 15 SCC 755, the Supreme Court of India reaffirmed the legislative intent by stating that the Domestic Violence Act of 2005 is enacted to provide a remedy in civil law for the protection of women from being victims of such relationships and to prevent domestic violence from occurring in the society as a whole. We also talked about other pieces of legislation, such as the Criminal Procedure Code, the Indian Penal Code, etc., that offer relief to women in precarious situations.

What is Domestic Violence?

According to Section 3 of the Domestic Violence Act of 2005, “domestic violence” includes not only physical beating but also emotional/mental/sexual/financial/other forms of cruelty that may occur within the home. Abuse on all fronts—including the physical, the sexual, the emotional, and the financial—is all defined in this section. For any act, omission, commission, or conduct of the respondent to be considered “domestic violence” under said section, the totality of the facts and circumstances must be considered.

Who can file a case under Domestic Violence Act 2005?

The ‘aggrieved person’ can make a domestic violence complaint. This term is defined in Section 2 of the Domestic Violence Act of 2005. Specifically, it refers to a woman who has been in a domestic relationship with the respondent (a man who has been in a domestic relationship with such woman) and who claims that the respondent has physically harmed her.

Domestic Relationship refers to a relationship between two people who live or have lived together in a shared household, and are related by:

  • Marriage,
  • A relationship in the nature of marriage (like live-in relationships),
  • Adoption,
  • Are family members,
  • Are related through blood relations.

This provision applies to situations where a man and a woman either rent or own a home together, or where a man and a woman live together with his joint family.

Provisions of the Domestic Violence Act 2005

  • The Protection Officer is appointed by the state government in accordance with Section 8 of the Domestic Violence Act of 2005. Between the aggrieved woman and the legal system, the Protection Officer acts as a go-between.
  • The Protection Officer’s responsibilities are outlined in Section 9 of the Domestic Violence Act of 2005.
  • A person experiencing domestic violence may require a wide range of services, including but not limited to housing assistance, medical care, childcare, legal representation, and more. Section 10(1) of the Domestic Violence Act of 2005 defines Service Providers as NGOs, or voluntary organizations registered under the laws of the State that provide services to victims of domestic violence.”
  • An aggrieved woman, in order to file a complaint for domestic violence may:
  • Approach the police station and register the complaint, or
  • File a complaint to a Protection Officer or Service Provider, or
  • Directly approach the Magistrate.
  • Section 5 of the Domestic Violence Act of 2005 lays out the responsibilities of the police, Protection officer, Service Provider, or Magistrate.
  • A protection order and other orders under the Domestic Violence Act 2005 must be issued by a court that is either a first-class magistrate’s court or a metropolitan court, as stated in Section 27 of the Domestic Violence Act of 2005.

घरेलू हिंसा अधिनियम 2005 का महत्व

घरेलू हिंसा अधिनियम 2005 के तहत कौन मामला दर्ज कर सकता है?

'पीड़ित व्यक्ति' घरेलू हिंसा की शिकायत कर सकता है। यह शब्द 2005 के घरेलू हिंसा अधिनियम की धारा 2 में परिभाषित किया गया है। विशेष रूप से, यह उस महिला को संदर्भित करता है जो प्रतिवादी के साथ घरेलू संबंध में रही है (एक पुरुष जो ऐसी महिलाओं के साथ घरेलू संबंध में रहा है) और जो दावा करता है कि प्रतिवादी ने उसे शारीरिक रूप से नुकसान पहुंचाया है।
