Representing the state government in the High Court, Advocate General Ashutosh Kumbhakoni informed the court that the situation in the state is extremely serious, and it will not be possible for the government to make arrangements for the ICSE Board Exam 2020. Though, in its affidavit filed with the court, the board has stated that it does not require permission from the state government to conduct the exams.

The above-mentioned replies and affidavits were filed by the parties in reply to a petition filed by Mr. Arvind Tiwari with the Bombay High Court. The matter is being heard by a division bench headed by Chief Justice Dipankar Dutta and Justice SS Shinde. In his plea, the petitioner has challenged the decision of the Maharashtra ICSE Board to conduct the pending exams for class 10th students in the state starting from 2nd July to 12th July 2020 across the state of Maharashtra. In his petition, the petitioner has stated that the number of COVID-19 cases in Maharashtra is still on the rise. Hence, it will be appropriate to direct the board to announce the results for class 10th students based on their grades in the internal assessment and past performance in the school.

Across Maharashtra, 226 schools are affiliated with ICSE, from which approximately 23,500 students will appear for the Maharashtra ICSE Board Exam 2020. Earlier, after the lockdown norms were relaxed in the state, ICSE decided to conduct the pending board examinations. But on 3rd June, it received a communique from the state government of Maharashtra stating that it will not be possible for the board to make arrangements for the examination. ICSE, though believed that with proper safety arrangements in place, exams could be conducted. Moreover, ICSE has also stated that students who are living in containment zones or whose family members or who themselves are suffering from COVID-19 can appear for the re-examination that will be conducted in the month of September 2020. The court has meanwhile put the matter up for hearing next week.

The MHA has also demanded strict adherence to the safety guidelines while the pending examinations are to be resumed by the CBSE, ICSE, and the state boards, with complete compliance with the rules to ensure the safety of the students and the personnel involved in the examination process. “Taking into consideration the academic interest of a large number of students, it has been decided to grant exemption from the lockdown measures to conduct Board Examination for Class 10th and 12th, with few conditions like social distancing, face mask, etc., for their safety” read the notice from Mr. Amit Shah.


Detailed Guidelines For Conducting The Exams Issued

The Board Exams of any boards, CBSE, ICSE, or the state boards are not allowed to be conducted in containment zones. Other guidelines as per the official circular released by the Ministry of Home Affairs are as given below.

  • Face masks are mandatory and should be worn by the students, teachers, and staff throughout the process, at all times.
  • The examination centers are expected to have thermal screening and hand sanitizers.
  • The states and Union territories should arrange transportation facilities on special buses for the students writing the board examinations.
  • The social distancing norms have to be properly followed in every exam center.
  • As many other boards are yet to conduct their examinations, the boards are instructed to ensure a staggering examination schedule.

It was on May 18 that the Central Board of Secondary Education, CBSE, announced their examination schedule for the conduct of the remaining papers of class 10 and class 12 board exams. The TN SSLC dates had also been announced recently. In addition to this, examinations of many boards, like TS SSC, AP SSC as well as pending Maharashtra HSC are expected to be released soon.

In view of the difficulties that the students might face in traveling long and wide for writing the exam, the HRD Minister has also announced that the exams would be conducted in the same schools where the students are enrolled in.
